Privacy and Personal Data Processing Policy

2. General

2.1. This Policy sets out how the personal data of users of the «Motyga» service (the “User”) is processed and protected. The Policy is made available on the website.

2.2. Processing is based on the concluded contract (the Offer), the User’s consent, and the law. Where consent is required it is specific, informed and conscious.

3. Data processed

• account identifier and name, e-mail address;
• the User’s request texts and history;
• transaction records, payment identifier and payment/refund status at the payment service;
• technical data: IP address, cookies and session identifiers, device and browser data (user-agent);
• security logs and usage metadata (selected model, request volume, date and time).

The Operator does not request special categories of personal data. Users should not submit passwords, access keys, passport or banking data, or legally protected secrets.

4. Purposes, bases and retention

4.1. Data is processed for the following purposes:

• providing access and performing the contract — basis: the Offer; retention: until the account is deleted and for the limitation period;
• processing requests by the selected model providers — basis: contract and consent; retention: request history — 14 days from last interaction, generated media — up to 30 days or until deleted by the User;
• settlements and NPD receipts — basis: contract and law; retention: for the tax-accounting period;
• security — basis: the Operator’s legitimate interests and the law; retention: up to 12 months for security logs.

4.2. Actions performed: collection, recording, systematisation, accumulation, storage, updating, use, transfer, blocking, deletion and destruction; automated and mixed processing.

5. Transfer to third parties

5.1. Data is transferred to the following categories of recipients to the extent necessary:

• the payment service (YooKassa) — to accept payments and refunds;
• third-party neural-network model providers — to process requests;
• infrastructure and communication providers — to operate the Service;
• state authorities — where required by law.

5.2. No other transfers occur.

6. Localisation and cross-border transfer

6.1. When collecting personal data of RF citizens via the website, primary recording, systematisation, accumulation, storage and updating are performed in compliance with Part 5, Art. 18 of Federal Law No. 152-FZ.

6.2. Some model providers may be located outside the Russian Federation. Cross-border transfer is carried out on a lawful basis and in compliance with Art. 12 of Federal Law No. 152-FZ, including notification of the competent authority. This document does not disclose server addresses.

7. Data-subject rights

7.1. The User may obtain information about the processing, request correction, blocking or deletion, withdraw consent, receive a copy, and appeal the Operator’s actions to Roskomnadzor or a court.

7.2. Requests go to support@motyga.com or via the account settings. The Operator responds within the periods set by Federal Law No. 152-FZ (generally within 10 business days, extendable by up to 5 business days). The Operator may request information to verify the applicant’s identity.

8. Safeguards

8.1. The Operator applies legal, organisational and technical measures to protect data, including access control and transfer over secure channels.

9. Cookies

9.1. The site uses only technical cookies needed for the account and session. The User may restrict them in the browser, which may affect some features.

10. Age restriction and changes

10.1. The Service is intended for persons over 18; the Operator does not knowingly collect data from minors.

10.2. The Operator may amend this Policy; the current edition is published on the website and takes effect upon publication.
